日本の殺人罪は故意による殺人をさす。過失による殺人は、過失致死罪か傷害致死罪になる。故意による殺人であるかどうか、殺意があるかどうかで変わる。日本の法定刑では、殺人罪は死刑もしくは5年以上の懲役が課せられる。殺意があるかどうかは、傷の程度、犯行後の言動、動機の有無により客観的に判断される。傷害致死罪が適用された場合、3年以上の有期懲役になる。日本の無期懲役と終身刑は異なる。無期懲役の場合でも、10年経つと仮釈放され、社会復帰できる可能性がある。日本は終身刑を導入すべきだ。

Translation

In Japan, murder means a murder case with intension.
The one without intension becomes manslaughter or inflicting bodily injury resulting in death.
The basis to decide is whether there is a intention to kill or not.
In the Japanese statutory penalty, the murder is assigned to the death penalty or penal servitude more than five years.
It is determined objectively whether there is a murderous intent by degree of the wound, behavior after the crime, and having motive or not.
When a charge of inflicting bodily injury resulting in death is applied, it becomes the penal servitude for a definite term more than three years.
The penal servitude for a indefinite term is different from imprisonment for life of Japan;
even in case of the penal servitude for a indefinite term, a criminal has possibility to be paroled and come back to normal life when ten years pass.
Japan should introduce imprisonment for life.
