保育業務委託契約書
●●（以下「保護者」）と、株式会社ABCが運営する「XXXX」（以下「当幼児園」）は、当幼児園を利用する園児●●（以下「園児」）の保育について、以下の通り委託契約（以下「本契約」）を締結しました。
第１条（契約の目的）
園児の健やかな成長のため保護者と当幼児園は互いに協力し合いながら、当幼児園は、児童福祉法、保育所保育指針、認可外保育施設指導監督基準の趣旨に従い、園児が安心して生活できる保育を提供し、保護者は、当幼児園に対して園児の保育に対する料金を支払います。
Contract of Entrusting Nursing Care
xx (hereinafter referred to as "parent") and "XXXX" that ABC Corporation manages (hereinafter referred to as "this kindergarten") executed an Entrusting Contract (hereinafter referred to as "this contract") as listed below in respect with the child xx who goes to this kindergarten (hereinafter referred to as "child").
Article 1: Purpose of Contract
This kindergarten provides a nursing care where the child stays relaxed subject to child welfare law, policy of nursing care of the kindergarten and purpose of supervision standard of unauthorized child care facility by mutual cooperation of parent and the kindergarten for growing the child in good health. The parent shall pay to the kindergarten for child care of the child.
第２条（保育の場所）
保育の提供場所は、横浜市●●とします。
第３条（保育サービスの内容）
１ 当幼児園は児童福祉法、保育所保育指針、認可外保育施設指導監督基準に沿って、園児の発達に必要な保育サービスを提供します。
２ 当幼児園が提供する保育サービスの内容は「当該年度のABCスクールガイドブック」の通りとします。
第４条（利用開始手続）
１ 保護者は、当幼児園の利用開始前に、当幼児園が指定する必要書類を作成し、当幼児園長へ提出します。
Article 2 (Place of nursery)
The place to provide the nursery is assumed at Yokohama-shi ●●.
Article 3 (Content of nursery service)
1 Our kindergarden provides nursery service necessary for the development of the kindergartener along the Child Welfare Law, the nursery school childcare guidance and the unauthorized child-care facility instruction supervision standard.
2 The content of the nursery service that our kindergarden provides is in accordance to "the ABC school guidebook of the year concerned."
Article 4 (Usage start procedure)
1 Thprotectors make the required document which our kindergarden appoints before the usage start of our kindergarden and submit it to the Director.
２ 当幼児園長は、保護者が提出する書類及び料金の納入に不備がある場合は、当該不備が是正されるまで園児の当幼児園の利用を停止することができます。
第５条（契約期間）
１ 本契約の契約期間は、平成29年4月1日から平成30年3月31日迄とします。
２ 期間満了日の30日以前に、保護者から当幼児園に対して、書面により契約終了の申出がない場合、次年度の4月1日から3月31日までの1年を契約期間として本契約を更新するものとし、更新後も同様とします。
2. In case where there is a mistake in the document submitted by parent and payment of the fee, head of the kindergarten is allowed to stop the child coming to the kindergarten until the said mistake is corrected.
Article 5: Contract Period
1. The period hereof shall be from April 1st 2017 through March 31st 2018.
2. If the parent does not inform termination of the contract in writing to the kindergarten prior to thirty (30) days of expiration of the contract, this contract shall be renewed by understanding that the contract period is from April 1st to March 31st of the next year. The same shall apply thereafter.
３更新時に、契約内容についての別途の合意がない場合には、更新前と同一条件にて契約が更新されるものとします。但し、保護者は2歳児クラスから3歳児クラスになる年度において契約を更新する際には、本契約第7条（ア）に規定する通り、月額保育料が変更されることを保護者は確認しました。
４園児が就学年齢に達する年度の3月末日を更新の限度とします。
第６条（利用時間及び休園日）
１基本的な利用時間は、次の通りとします。
・8：30～17：00
バス送迎利用の場合、上記利用時間から前後する場合があります
3. When renewing the contract, if details hereof is not agreed other than this, the contract shall be renewed under the same condition as before the renewal. However, when parents renew the contract in the year promoting from second (2) years old to three (3) years old, they confirmed that the monthly fee of nursing care is changed subject to Article 7 (a) herein.
The last renewal must be made at the end of March when 4 years old starts going to school.
Article 6: Use hour and Day of closing
1. The basic hour they are allowed to use is as follows.
8:30 to 17:00
In case of using the pick up bus service, the hour above is subject to change.
２ 利用時間の延長は、次の通りとします。
・7：30～8：30／17：00～19：00
３ 休園日は、当幼児園が定めるABC園規則に定めるものとします。
第７条（利用料金）
保護者は、当幼児園による保育サービスの対価として、以下の項目のうち、園児が保育サービスを受けたものについては、次の通り料金を支払うものとします。（いずれも税込料金としますが、契約期間中に税率の変動があった場合には、新税率適用後の利用料金を支払います）
2 Extension of the time of utilization is as stated below.
・7:30am - 8:30am / 5:00pm - 7:00pm
3 The kindergarten closes according to ABC regulations established by the kindergarten.
Article 7 (Charges for use)
Regarding the services that children have taken among the following items, as consideration for the childcare services by the kindergarten the guardians shall pay the service charges according to the following. (All the prices include taxes, however the guardians shall pay the charges for use after a new tax rate is applied if there is a change in a tax rate during a contract period.)
（ア）月額保育料（基本的な利用時間における保育の利用料）
２歳児クラス 97,200円／月
３～５歳児クラス 86,400円／月
＊4月1日時点での年齢に基づきます。
（イ）施設利用料
（ウ）昼食費（おやつ込み）
（エ）延長保育利用料（延長時間における保育の利用料）
（オ）各種オプション料金
バス送迎費10,800円／月
第８条（料金の支払い）
１ 月額保育料、施設利用料、昼食費及びバス送迎費は、翌月分を当月２０日に、保護者指定の金融機関口座からの自動引き落としの方法により支払うものとします。
(a) Monthly childcare fee (charge for childcare on the basic use time)
2-year-old class: 97,200 yen a month
3-5-year-old class: 86,400 yen a month
*Based on the age as of April 1.
(b) Facility Use fee
(c) Lunch expenses (including snacks)
(d) Extension childcare fee (charge for extension childcare)
(e) Optional various kinds of fees
Pick-up bus fare: 10800 yen a month
The eighth article (payment for fees)
1. Monthly childcare fee, facility use fee, lunch expense or pick-up bus fare will need to be paid by automatically from a bank account which parents designate on 20th for this moth as the next month cost.
２ 延長保育利用料及び夕食費は、当月分を、翌月２０日に、保護者指定の金融機関口座からの自動引き落との方法により支払うものとします。ただし、退園月や卒園月については、この限りではありません。
３ 前２項に拘わらず、入園金、初回請求費用に関しては当幼児園が指定した期日までに、銀行口座に振込支払うこととします。
４ 保護者は、園児が月の途中で入園又は退園した場合においても、入園又は退園をした月についての、１カ月分の月額保育料及び施設利用料を支払うものとします。
2. The fee of using the nursing care by extended hour and fee of super for the month shall be paid from the account of financial institution designated by parents by means of automatic withdrawing on twentieth (20) of the next month except for the month and year when they leave or graduate.
3. Notwithstanding the above preceding two (2) clauses, money of entering the kindergarten and fee charged for the first time shall be transferred to the account in the bank until the day the kindergarten designated.
4. In case where a child enters or leaves the kindergarten in the middle of the month, the parent shall pay the monthly fee of nursing care and using the facility for the month.
第９条（医療機関・提携内容）
当幼児園は、園児が急に発病した場合やけがを負った場合に、当幼児園が必要と判断した場合、医療機関に受診させることがあります。
また、園児のために、年２回の定期健康診断を実施します。
第１０条（契約の解除）
１ 保護者は、保護者又は園児の事情等で当幼児園を中途退園する場合は、退園を希望する月の２か月前の月の末日までに退園届を提出の上、申し出ることとします。
Article 9: Medical Institution and Details of Partnership
If a child becomes ill or injured suddenly and the kindergarten decides its needs, the child might go to medical institution to see a doctor.
We have a regular medical checkup for the children twice a year.
Article 10: Cancellation of Contract
1. If a child leaves the kindergarten by reason of the parent or child, the parent must inform its intention by submitting a report of leaving until the end of two (2) months prior to leaving.
２ 当幼児園は次の各号のいずれかに該当する場合、書面にて保護者に通知することにより、事前の催告又は通知を要することなく、この契約を解除することができます。
（ア）保護者が本契約第８条に定める料金の支払いにおいて、所定の期日を過ぎても支払いがない場合
（イ）保護者等関係者が、園規則など園の運営ルールを守らない場合
（ウ）保護者等関係者が園の運営を著しく阻害する場合
2. If covered under any of the followings, the kindergarten may cancel this contract without prior notification by notifying the parent in writing.
(a) In case where the parent does not pay after the designated day in the payment of the fee designated in Article 8 hereof;
(b) In case where those involved including the parent do not observe the rule of management of the kindergarten such as regulation of the kindergarten;
(c) In case where those involved including the parent prevent management of the kindergarten remarkably.
（エ）園児に、心臓疾患、てんかん若しくはアレルギー体質等、当幼児園が園児に対し保育サービスを提供する過程で特別の配慮を要する持病、疾患、傷病若しくは特異体質等があることが判明した場合
（オ）園児に、持病、疾患、傷病若しくは特異体質等、保育サービスを提供する過程で特別の配慮を要する事情があることにより、当幼児園として、保育のサービスの提供を継続することに特有の困難が伴うと判断した場合
(D) When it is found that Kindergarten Pupil has heart disease, epilepsy or allergic constitution etc, such as diseases, diseases, injuries or idiosyncrasies requiring special consideration in the process of providing childcare service to the child by XXXX.
(E) In the case that XXXX judges that it is difficult to continue providing childcare services because of circumstances such as chronic disease, disease, injury or idiosyncrasy that require special consideration in the process of providing nurseries to Kindergarten Pupil.
