（損害賠償）研修生が、Ａ社又はＡ社のスタッフに対して損害を与えた場合には、前条の保険により賠償させるものとする。保険では填補されない損害が、研修生の故意・又は重過失によるものであるときは、当該損害全額について研修生は賠償の責任を負い、Ｂ社はこれを連帯して保証する。研修生が、Ａ社及びＡ社のスタッフ以外の第三者に損害を与えたときは、原則として研修生が責任を負い、対応するものとする。又、Ｂ社はこれを連帯して保証する。但し、損害の発生がＡ社の指示に起因するときは、この限りではない。

(Damage compensation) If a trainee gives damage to A or staff of A, they shall be compensated by insurance set forth in the preceding article. In case where damage not compensated by insurance is caused by intention or gross negligence of the trainee, the trainee shall be liable for the said damage by whole amount, and B shall jointly guarantee it. In case where the trainee gives damage to third person other than A and staff of A, the trainee, in principle, shall be liable for it and work on it. Or B shall jointly guarantee it. However, this shall not apply in case where the damage is caused by instruction of A.

(Indemnity) In the event of a trainee causing damage to A or A's staff, s/he shall indemnify the damage pursuing to the insurance in the preceding paragraph. In the case of the damage due to the trainee's willful or gross negligence and not covered by the insurance, the said trainee shall be liable for the indemnity pertaining to the damaged cost in full, and B will serve as a joint guarantor. In the event where the trainee caused damage to a third party other than A or A's staff, as a ground rule, the trainee shall be liable for the responsibility to respond. Also, B shall serve as a joint guarantor. This however does not apply if the damage was caused due to A's instruction.

(Compensation for damage) When a trainee caused damage to A company or company's staff, compensation shall be made under preceding Article. If this damage that cannot be covered by this insurance is the trainee's intention or negligence, the trainee should be responsible for compensation of this whole amount of damage and B company guarantees this together with him. If a trainee causes damage to a third person except A company or A company's staff, as a rule, the trainee shall be responsible and apply for that. In addition, B company guarantees this together with him. However, if the occurrence of damage is caused by A company's order it shall not apply.
