権利を保護するための「意匠権」出願のための要件のひとつに「新規性」があります。ですので、原則は、既に公開されている意匠は意匠登録を受けることができません。

しかし、現実的にはコンペや展覧会への出品等、出願前に意匠が公知になる機会もあるため、意匠登録を受ける権利を有する者（意匠の創作者又はその承継人）であれば、公開してから6ヶ月以内は意匠権を出願することが出来るという「例外規定」があります。

One of the requirements for "the design right" applications to protect the right is "the novelty." Because of it, in principle, the design registration cannot be granted to the already published design.

However, there is "the escape clause" that those who is the person having the right to receive registration of a design (a creator of the design or the successor) can apply for the design right for less than six months after the publication because we may have the competition, the exhibition, etc. with the opportunity when design can become well known before the application practically.
