権利を保護するための「意匠権」出願のための要件のひとつに「新規性」があります。ですので、原則は、既に公開されている意匠は意匠登録を受けることができません。

しかし、現実的にはコンペや展覧会への出品等、出願前に意匠が公知になる機会もあるため、意匠登録を受ける権利を有する者（意匠の創作者又はその承継人）であれば、公開してから6ヶ月以内は意匠権を出願することが出来るという「例外規定」があります。
