1 さらに、上訴制度を設けた場合には仲裁コストの増加(弁護士費用、仲裁人費用)が避けられず、上訴制度を設けるべきとの主張は妥当じゃない。
5 ５２条と５３条に当てはまるかどうかを厳格に検討し、要件に該当する場合にはannulment of under the ICSD Conventionはやむをえないものと考える。
