“In the meantime, the appellees were allowed to occupy or lease to a
tenant Pineda’s California property (Exh. “A-1”, p. 17, Ibid) and Pineda
was authorized to occupy appellees’ White Plainsproperty (Complaint; p. 8.
Records). Pursuant to the exchange agreement, Alejandria Pineda paid
the appellees the total amount of $12,000.00 broken down as follows: 1)
$5,000.00, on January 1983; 2) $4,000.00 on April 1983; 3) $3,000.00 on
January 1985 (Exh. “C” & “D”, pp. 28; 36 Ibid).
一方、被譲渡人は、ピネダのカリフォルニアの土地を占領または他者へ賃貸することができた（付録A-1,１７ページ、同書）。ピネダは、被上訴人のホワイトプレインズの土地を占領することができた（苦情；８ページ 記録）。
交換契約に基づき、アレハンドリア・ピネダは被上訴人へ総額１２，０００.００ドルを支払い、その仔細は、以下の通りである。
１）１９８３年１月： 5,000.00ドル
２）１９８３年４月： 4,000.00ドル
３）１９８５年１月： 3,000.00ドル
