1-1 UserVoice Inc. ("UserVoice" or the "Company") offers UserVoice (the "Service") according to the terms of service (the "Terms of Service"), as well as the privacy policy (the "Privacy Policy"), which together constitute an agreement (the “Agreement”) declared below. The Company reserves the right to modify these terms without notice. Your continued usage of the Service, as either a user or an Account Holder (as defined below), constitutes your acceptance of these terms, available at http://uservoice.com/tos. Violation of any terms will result in termination of your account. Questions about the Terms of Service may be sent to support@uservoice.com.
1-1 UserVoice Inc. (以下「UserVoice」または「提供会社」) は、以下に規定する契約 (以下「本契約」) を構成する利用規約 (以下「本規約」) とプライバシーポリシー (以下「本プライバシーポリシー」) 従い、UserVoice (以下「本サービス」) を提供します。提供会社は予告なくこれらの規約を変更する権利を有します。ユーザーまたはアカウントホルダー (以下に定義) による本サービスの使用は、http://uservoice.com/tos に示される利用規約に同意したものとみなされます。規約の違反が発見された場合、アカウントは停止されます。本規約についてのご質問は support@uservoice.com までご連絡ください。
1-2 General Terms
The Service is not intended for children under 13. By using the Service, you are representing that you are at least 18, or that you are at least 13 years old and have your parents' permission to use the Service.
The Company can refuse registration or cancel an account in its sole discretion at any time.
You are responsible for using the Service in a private and secure manner. The Company is not liable for any damage or loss due to unauthorized account access resulting from your actions, such as sharing your account password or not logging out of the Service.
1-2 一般契約条件
本サービスは 13歳未満の者は利用できないこととします。本サービスを利用するには、ユーザーは 18歳以上であるか、または 13歳以上であり本サービスを利用を両親から許可されている必要があります。
提供会社はいつでも任意の理由で、登録を拒否またはアカウントを取り消すことができます。ユーザーは本サービスの利用に当たって、プライベートや安全性にかかわるマナーを守る責任を負います。提供会社は、パスワードを共有したり、ログアウトを怠ったりというような、ユーザーの行動を原因とする不正なアカウントのアクセスに起因するいかなる損害についても責任を負いません。
1-3 You may not register accounts with unauthorized automated methods ("bots").
You may not use the Service for any illegal activity or to violate laws in your jurisdiction.
You may not use the Service to distribute unsolicited email ("spam") or malicious content such as viruses or worms.
You may not exploit the Service to access unauthorized information.
Any abuse or threatened abuse of other users of the Service or of Company personnel will result in immediate account termination.
Any failure of the Company to enforce or exercise a right provided in these terms is not a waiver of that right.
1-3 ユーザーは、不正な自動化された手法 (「ボット」) でアカウントを登録してはなりません。
ユーザーは、いかなる不法活動、またはユーザーの管轄域の法に違反する活動のために本サービスを利用してはなりません。
ユーザーは、受信者に求められない電子メール (「スパム」) や、ウイルスやワームのような悪意あるコンテンツを配信するために本サービスを利用してはなりません。
ユーザは、権限の無い情報にアクセスするために本サービスを活用してはなりません。
当サービスの他のユーザーまたは提供会社の人員の乱用は、あるいは脅迫によるものであっても、アカウントは直ちに停止されます。
提供会社がこれらの規約を施行または行使できない場合でも、その権利が放棄されたとはみなされません。
1-4 Should any provision of these terms be found invalid or unenforceable, the remaining terms shall still apply.
This Terms of Service constitutes the entire agreements between you and the Company and supersedes any and all previous agreements, written or oral, between you and the Company, including previous versions of the Terms of Service.

1-5 These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without giving effect to principles of conflicts of law. You and the Company each agree that any action at law or in equity arising out of or relating to these Terms of Service will be filed only in the state or federal courts in and for San Francisco County, California, and hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action.
1-5 本規約は、抵触法の原則に影響を与えない限りにおいて、カリフォルニア州法に配下にあり、これに従って解釈されます。ユーザーと提供会社の双方が、法に基づいて公平に、本規約の範囲外または関連する行為について合意を得ようとする場合、カリフォルニア州サンフランシスコの州裁判所または連邦裁判所にのみ申し立てることとし、訴訟のために同意書は個人と裁判所の専属管轄地域に提出することとします。
1-6 Payment, Refunds, Upgrading and Downgrading Terms
A valid credit card number is required for paying accounts. Free accounts do not require a credit card number at registration.
If you initially sign up for a paid account, and you don't cancel that account within 15 days, you will be billed monthly starting on the 15th day (the “Billing Start Date”) after your account was initially created. If you cancel prior to the processing of your first invoice on the Billing Start Date, you will not be charged.
1-6 支払い、払い戻し、アップグレードとダウングレードについての規約
有料アカウントには有効なクレジットカードの番号が必要です。無料アカウントの登録ではクレジットカードの番号は不要です。
有料アカウントにサインアップし、15日間アカウントをキャンセルしなかった場合、最初にアカウントを作成してから15日目に月々の課金が開始されます (課金開始日)。課金開始日に最初の請求書が処理される前にキャンセルした場合は、料金は発生しません。
1-7 An upgrade from any free plan to any paid plan will end your free trial. Notwithstanding the above, you will be billed for your first month immediately upon upgrading.
The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.
1-7 無料プランから有料プランへアップグレードを行うと、無料試用は終了します。前項の定めにかかわらず、アップグレードにおいては、最初の月からすぐに課金が始まります。
本サービスは、月単位の前払いで請求を行い、払い戻しはできません。日割りによる払い戻しまたはクレジット払い、アップグレードまたはダウングレードによる払い戻し、開設済みアカウントの未使用による払い戻しはありません。公平のため、例外は設けません。
1-8 All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
For any upgrade or downgrade in plan level, your credit card will automatically be charged the new rate on your next billing cycle.
Downgrading your Service may cause loss of features or capacity of your Account. The Company does not accept any liability for such loss.
1-8 すべての料金には、税務局によって義務付けられるすべての税金は含まれていません。ユーザーはこれらの税金の支払いについて自身で責任を負うことになります。
プランのレベルのアップグレードまたはダウングレードにより、次の請求では自動的に新しいレートでクレジットカードに課金されます。

1-9 Cancellation and Termination
You may cancel your subscription at any time by clicking the "Change Plan" link from your account dashboard and downgrading to a Free plan. This will not delete any of your account data, but will switch you to the free plan and disable administrative access for your account. Should you wish to permanently delete all pages and feedbacks associated with your account, please contact us at support [at] uservoice [dot] com.
The Company reserves the right to suspend or terminate your account at any time for any reason, and is not liable for any damage or loss resulting from such suspension or termination.
1-9 キャンセルと停止
ユーザーはいつでも、アカウントのダッシュボードから「課金プラン (Change Plan)」リンクをクリックし、無料プランへダウングレードすることで、有料プランをキャンセルすることができます。これを行ってもアカウントのデータは削除されませんが、無料プランに切り替えると、アカウントへの管理者アクセスが無効になります。
アカウントに関連付けられたすべてのページとフィードバックを完全に削除したい場合には、support [at] uservoice [dot] com までご連絡ください。
提供会社は、ユーザーのアカウントをいつでも任意の理由で休止または停止させる権利を有します。この休止または停止によって発生した損害の責任は負いません。
1-10 Modification to Service and Fees
The Company reserves the right to modify, suspend, or discontinue the Service for any reason, with or without notice.
The Company reserves the right to modify any prices of the Service (such as the subscription fees). The Company agrees to provide 30 days notice of any price change, posted to the Service or emailed to all active Account Holders.
