In the above mentioned case we have received the enclosed Communication from the European Patent Office. In this Communication the Search Division objects, that the application includes multiple independent claims in the same category. Insofar we are invited to indicate by January 21 , 2012 at the latest, on the basis of which claims the search shall be carried out.
Please note, that we do not have the possibility to argue against the invitation at the present stage. However, we can argue that unity between the independent claims is given during the examination procedure.

上記のケースにおいては、当社は同封の欧州特許庁からの通知書を受領しました。この通知書の中で審査部門は、出願には同じカテゴリーに属する複数の独立請求項が含まれていると拒絶の理由を述べています。これについて、どの請求項に基づいて審査をしてもらうべきかの意思表示を遅くとも2012年1月21日までに回答するように欧州特許庁から求められています。
なお、現段階ではこの要求に対して反対意見を述べる余地はないことをご了承ください。しかし審査過程においては、各独立請求項間には共通した単一性があるという主張をすることは可能です。

上記の件に関して、我々はEuropean Patent Office（ヨーロッパ特許庁）からの書簡を受領しました。
書簡によれば、調査部は、当該の出願は一つのカテゴリに複数の独立したクレームが含まれていると主張しています。
遅くとも、2012年1月21日までに、どのクレームについて審査を行うべきかを、我々が明らかにすることが求められています。
現時点では、この要求について議論する余地がないことをご理解ください。
しかし、審査の過程で、それぞれのクレームが一体的なものであることを主張することは可能です。
