貴社の販売されている商品につきましてはB社に下記のことで対応が間違いないことを確認しております。
UPCコードがついていなくても同じ商品であれば同じカタログへ出品することが望ましい。
UPCコードがついているからといってオリジナル商品にはあたらない。
UPCコード管理団体に確認したところUPCコードを取得したことにより知的財産権や商標権を得られる
ものではない。

I have verified with Company B that the following is correct regarding the product your company sells.
Even without a UPC code, the same products should appear in the same catalogue.
Even with a UPC code, it does not mean that they are original products.
When I checked with the UPC code management organization, they confirmed me that obtaining a UPC code does not mean that it has gained intellectual property or trademark.

We are absolutely sure that company B will be providing the following action with regards to the products of your company that are being sold.
We hope that the products can be displayed in the same catalog if they are similar products even with the inclusion of the UPC code.
It is said that since it includes a UPC code, it does not necessarily translate to an original product.
After confirmation by the UPC code management organization, the trademark and intellectual property rights are not obtained by obtaining the UPC code.
パッケージにシールを貼っただけなどはオリジナル商品にはあたらない。
先行出品者から販売中止などの通知があった場合異なる商品の証明は、先の出品者が行う必要がある。
仮に問題になった場合、当事者間で解決を行う。
販売差止めなどのB側は基本的に感知しない。
If a previous seller informs of a sales suspension etc., the previous seller has to prove that the products are different.
If a problem occurs, both parties try to solve it.
Basically, B will not be involved in suspending sales etc.
If there was a notification from the previous seller to stop selling, then there is a need for the previous seller to certify the varying products.
If there are temporary problems then resolve it between the parties.
The sales suspension is basically not felt at the B side.
弊社も自社で商品ページを作成、育成していくことの大変さ、品質保持面での苦労も経験しており、貴社がそれを保持していきたい心情も理解できます。しかし同一製品であれば競争することでお客様により良い価格をご提示することで、最終的にお客様の便益が最大化すると思っています。

ルールは流動的に変化致しますんおで一度御社よりB社へ確認することをお勧め致します。
その上で弊社へのクレームを撤回しない場合は、弊社としても御社への対応をさせて頂きますので予めご了承ください。
Also, Company B has told us that it is not desirable to have multiple sales pages by obtaining UPC codes.
As the rules are constantly changing, we would recommend you check with Company B directly.
After that, if Company B does not withdraw its complaint, please be aware that our company will take an action against your company.
In addition, we have gotten answers on the undesirability with the crowded sales page with obtaining the UPC code per the opinion of B company.
The rule is not fluid so we recommend that you can confirm this with B company.
And if does withdraw the claim with our company, then please kindly understand that we will be handling this with your company.
