After communicating with OLIC, it turns out that they believe that they do not need to do anything and that the sponsors just need to carry out GMP Clearance of OLIC with the TGA.
Based on our understanding, we think there are 2 options:
1) OLIC obtains a new TGA Certificate of GMP Compliance (without on-site audit)
-> Kobayashi AU as a sponsor uses OLIC’s new TGA issued Certificate of GMP Compliance of OLIC to carry out a GMP Clearance
2) OLIC does NOT obtain a new TGA Certificate of GMP Compliance
-> Kobayashi AU as a sponsor obtains the necessary information based on “Evidence List B” from OLIC and carries out Compliance Verification to obtain a GMP Clearance
OLIC is misinformed. Option 1 is NOT possible. OLIC’s current “TGA Certificate of GMP Compliance” expired on 10 October 2015. It cannot be automatically extended by TGA. OLIC cannot obtain a new “TGA Certificate of GMP Compliance without an on-site audit by TGA inspectors. I have also confirmed this again with TGA GMP staff today.
The TGA has already stated several times they are NOT coming to Thailand to undertake a new GMP audit. This is because there is a recent FDA inspection which should provide adequate GMP compliance evidence for OLIC’s Australian customers (sponsors) to apply for GMP Clearances via the Compliance Verification process.
The only viable option is Option 2. Kobayashi AU needs to apply for a GMP Clearance via the Compliance Verification (TGA desktop audit) process. Kobayashi AU (and other OLIC customers) will need to obtain the necessary information based on the TGA Overseas Manufacturers “Evidence List B” from OLIC. We can submit the application now to get the process moving, and enclose a cover letter which commits to the provision of the required “Evidence List B” documentation from OLIC in due course.
We can then request the extension of the existing (expired) GMP Clearance, usually granted for six months.
