日本の殺人罪は故意による殺人をさす。過失による殺人は、過失致死罪か傷害致死罪になる。故意による殺人であるかどうか、殺意があるかどうかで変わる。日本の法定刑では、殺人罪は死刑もしくは5年以上の懲役が課せられる。殺意があるかどうかは、傷の程度、犯行後の言動、動機の有無により客観的に判断される。傷害致死罪が適用された場合、3年以上の有期懲役になる。日本の無期懲役と終身刑は異なる。無期懲役の場合でも、10年経つと仮釈放され、社会復帰できる可能性がある。日本は終身刑を導入すべきだ。
In Japan, the definition of the criminal homicide is the killing someone with intension. The involuntary homicide is classified as either the manslaughter or the bodily injury resulting in death. The charge of homicide is varied depending on the intentional or not. In Japan, the statutory penalty, if convicted, of the criminal homicide is either the capital punishment or the imprisonment of more than five years. The homicide with a murderous intention or not is objectively judged based on the degree of injury, the words and deeds during the investigation and with or without motive. When a suspect is convicted by inflicting the bodily injury resulting in death, the rendering decision is the imprisonment with work with definite term with the term of more than three years. The penalty of the indefinite prison term in Japan has different interpretation from the life imprisonment. Although the conviction is the indefinite prison term, a convicted is released on parol after the penal servitude for ten years with potential opportunity for reintegrating into the society. Japan should introduce the criminal penalty of the perpetual punishment.
